Seventh FCI Dublin Officer Sentenced for Sex Crimes as Prison Turmoil Grows

A seventh correctional officer is sentenced to prison for sexually abusing five female prisoners at the Federal Correctional Institution Dublin (FCI Dublin), in Dublin, California.

Nakie Nunley, the former supervisor at the prison’s call center, was sentenced to six years behind bars.

"He is one of the most egregious officers out there," said U.S. District Court Judge Yvonne Gonzalez Rogers during the sentencing hearing. "He did this day and in day out for months." 

Nunley pleaded guilty in September 2023, to various charges, including four counts of sexual abuse of a ward, five counts of abusive sexual contact, and one count of making false statements.

Nunley also admitted his guilt related to sexual acts and sexual contacts with five separate women and to lying to Justice Department Office of Inspector General (DOJ-OIG) agents. Prosecutors say he admitted to abusing two other women that were not part of the case, as well as engaging in inappropriate conduct with multiple other victims.

“Nakie Nunley egregiously exploited his authority by sexually abusing multiple incarcerated women and then retaliating against those who blew the whistle,” said Deputy Attorney General Lisa Monaco. “As today’s sentence shows, the Justice Department will hold accountable officials who abuse their authority to harm those they are sworn to protect — and will not tolerate retaliation against victims.”

Prosecutors say the victims all worked at the UNICOR (the trade name for federal prison industries) call center at the prison. Nunley was assigned to supervise them.

In addition to the sexual assault, prosecutors say Nunley threatened prisoners who complained about his conduct. One was told she could lose her job and get transferred to another federal facility, while another was told if she wanted to keep her job, she needed to “pull down her underwear and bend over.”

DOJ-OIG and the FBI investigated the case.

“The DOJ-OIG will continue to aggressively investigate sexual abuse at FCI Dublin and across the Federal Bureau of Prisons,” said DOJ-OIG Inspector General Michael Horowitz.

FCI Dublin Turmoil

Nunley is the seventh former FCI Dubin officer to be sentenced for sex crimes since 2021. An eight, Darrell Smith, is awaiting trial. Those sentenced include former Warden Ray Garcia.

And the turmoil continues at the facility.

The Federal Bureau of Investigation (FBI) conducted a raid on the prison in early March 2024 over the sexual assault cases.

FCI Dublin Warden Art Dulgov and three other managers were removed in the raid. Dulgov was removed after just months on the job, after allegations that his staff retaliated against an inmate who testified in a lawsuit against the prison. The inmate was transferred to a different prison despite a judge’s order not to transfer any prisoners without court approval.
